Guardianship / Conservatorship

Morris & Bryson provides assistance to families in evaluating and facilitating guardianship and its alternatives.

Guardianship is the formal process involving the Probate Court in which an individual is appointed to handle all healthcare decisions for a person unable to make their own decisions.

Conservatorship is the formal process involving the Probate Court in which an individual is appointed to handle all of the finances for a person unable to manage their own assets.

Where capacity exists, powers of attorney and revocable trusts are utilized to avoid the need for a guardian and conservator. Pre-planning to avoid guardianship and conservatorship is usually preferred as to avoid court costs, attorney fees and court oversight.
